Take control of your work by taking control of your data Driver's Seat Cooperative ("DSC," "we," "us," or "our") was founded to empower gig workers, specifically those who earn money through Internet-based ride-hailing and delivery services, to take control of their work lives through the insights revealed when data is shared, analyzed and aggregated.

The data you generate through your work is super valuable. But until now, you've been shut out of that value. DSC puts you in control by giving you data driven insights with the goal of helping you earn more money in less time. And, we want you to see the value of your data when it's aggregated with that of thousands of other gig workers. To do that, we must collect, analyze, and sometimes share personal information about you. This Privacy Notice is part of our effort to empower you to make wise decisions about not only when and where you drive but also the personal information you share when you use our services.

When you visit our Website or use our App ("Driver's Seat"), you share your personal information with us in various ways. We also may collect personal information directly from you in person or by phone. Sometimes we collect it directly from you, and other times, we use technology to automatically collect personal information

Empowerment requires transparency. Our goal with this Notice is to make clear how you benefit from sharing personal information with DSC, who we share it with and when, and how we keep it safe – along with giving you the necessary tools and options to manage and protect that information.

This policy applies to our Website, App, and any sites or products that display these terms (collectively, the Platform). It does not apply to any website, mobile app, service, or product that does not display or link to this Privacy Notice or that contains its own privacy policy. If you do not agree with our policies and practices, please do not use our Platform. By accessing or using our Platform, you agree to this Notice.

How we collect personal information

We may collect personal information from you directly or indirectly. When you register with us as a driver on our App or on our Website, or fill out a form on our Website, you provide personal information directly to us. We also use technologies, such as our App, that collect data (including personal information) automatically as you use them. Another example of automated, indirect data collection is our use of "cookies" on our Website and App. We also may collect personal information when you use third parties, such as social media platforms.

Our Platform is not for use by anyone under 18 years old

As stated in our Terms of Service, you must be 18 to use our App. As a result, we will never knowingly collect personal information from anyone younger than 18 years. If we become aware that personal information of anyone younger than 18 has been provided to DSC, for any purpose, we will delete the information from our files.

We collect personal information when you provide it

When using our Platform, you may provide certain kinds of personal information directly by interacting with DSC online and offline (via social media or Web forms, by phone, email, in person – or even through regular old postal mail).

When you register for an account with us on the Website or the App, you will need to provide your email address, name and zip code and create a password. Your email address and password will be used on subsequent visits helps us confirm your identity and make it easier to use our services. You may also choose to provide us with other personal information, at your option, which may include your phone number, age, gender, ethnic background, and earnings and expenses associated with your work.

Where you allow us to do so (based upon your mobile device settings), the App will collect location information associated with your work-related movement activity (such as driving, bicycling or walking), which is collected when you activate the App's work shift button.

In addition, where you use our earnings analysis tools, you may elect to provide us with certain tracking and earnings information (manually or automatically where you integrate with a third-party service as described below) such as the name of the gig provider, dates worked, start time, end time, active time, number of deliveries, base pay, customer tip, promotional/premium pay and merchant name.

We currently offer the ability for you, if you choose, to integrate your App account with a third-party data aggregator (Argyle). If you do so, this will activate automatic tracking and upload your earnings to your App account. Where you select this option, , we will receive personal information from Argyle associated with your accounts on gig-work platforms. This information is both historical (backward looking) and on-going (forward looking). The information we receive is limited to your platform account profile, work activities, vehicle information, and ratings and reputation information ("Your Platform Account Information").

Some of the information described above may be personal information and we may share this information with select third parties who support our ability to provide you with this service. See "When we share personal information" for additional detail on when we share information with third parties.

We collect personal information from third-party sources

We may collect personal information about you from third parties, such as online social networks if you take part in a forum, for example, or follow DSC on Facebook or Instagram. We may collect personal information when you click "Share This" or "Like" buttons or otherwise use social media buttons, plug-ins or refer to us using hashtags like #driverseat or #ourdata. Note that any personal information collected by a third party, such as a social networking site, is handled based on their privacy practices rather than this Notice.

We may share deidentified or aggregated mobility and workforce data with municipal or state governments and/or transportation agencies, and they may share insights with us. Though aggregating in this way generally strips out most personal information, it may include certain data such as the specific time and location of work-related trips. It will never include your name, email address, or phone number unless you give us specific consent to share that information.

We collect personal information using automated technologies

Sometimes personal information is collected by automated technologies and shared with us when Website visitors and App users navigate through our products and services. We may track your browsing actions and log your IP address. During the driver registration process we will collect device ID (typically a phone or tablet). When you have downloaded the App, it will run in the background and it will collect time-stamped location data when you activate the App's work shift button.

Automated collection technologies – such as cookies, beacons, tags, and scripts – are used by us to improve user experience with the Platform, analyze trends, administer the Platform, and track users' movements around the Platform. We, and our third-party partners, also use these technologies to gather demographic information about our user base as individuals and in the aggregate.

A "cookie" is a small text file that is stored on an individual's computer and downloaded to the computer or mobile device when he or she visits a website. Cookies then send information back to the originating website on each subsequent visit, or to another website that recognizes that same cookie. We use different types of cookies:

  • Essential and Required Cookies. These are cookies that are required to make our Website or App function properly and cannot be turned off in our systems. If you block these cookies, portions of our Website or App may not function properly.
  • Performance and Functional Cookies. Performance and functional cookies allow us to count visits and sources of traffic on our Website and app so we can measure and improve their performance and functionality. They help us know which pages of our Website are most and least popular, which features of the App are used most, and how visitors move around the Platform.
  • Targeted Advertising Cookies. Advertising cookies may be set through our Website and App by our advertising partners. They may be used by those companies to build a profile of your interests and show you relevant advertisements on other sites.
  • Social Media Cookies. These cookies allow you to share information using social media sharing buttons (such as the Facebook "Like") on social networks like Facebook, LinkedIn, Instagram, or Twitter. This information may then be used by the social media network to deliver targeted advertising to you.

We may use cookies to aggregate personal information collected automatically with data (including personal information) previously stored from other interactions with our Website or App and third-party sites. We examine metrics, such as which pages you visit or features you use, which links you click on and resources you view, the performance of our marketing efforts, and your response to those marketing efforts. This allows us to offer relevant and useful information to drivers.

If you wish to opt out of allowing certain cookies, you may do so by changing your browser settings so that cookies from our Website cannot be set. Please note that if you delete, block, or otherwise restrict cookies, or use a different computer or Internet browser, you will need to renew your cookie management choices.

Do-not-track requests

Some browsers offer a "Do Not Track" privacy preference. Generally, when a user turns on the Do Not Track Signal, their browser sends a message to websites requesting that the user not be tracked. Our Website and services currently do not respond to "Do Not Track" signals.

How we use personal information

We use personal information to give you insights you may use to improve your earning strategies, to help on-demand workers see the big picture on ride-hail and on-demand delivery platforms, and to improve our services. We know your personal information is important to you, so we want to be transparent about how we use that information. Here are the ways we use personal information at DSC:

  • To provide access to the Website and App, including maintaining the security and integrity of both.
  • To analyze large-scale on demand driving and delivery data that provides workers with the information they need to work most effectively, which may include not only geolocation data but sometimes the make, model, and engine type of their cars.
  • To share questions, feedback, or other content drivers have elected to provide.
  • To provide marketing information regarding Platform updates and special promotions, etc.
  • To comply with legal and regulatory requirements applicable to our business and internal policies for maintaining records.
  • To protect all parties (drivers, municipalities, and transportation agencies) in the event of disputes.
  • To conduct reviews of our Website and App. Understanding how drivers use them allows us to improve product offerings and drivers' experiences – and more efficiently market promotions to make their experience more efficient.
  • To comply with court orders and legal processes, and to enforce our Terms of Use and this Privacy Notice.
  • For any other legal, business, or marketing purposes that comply with the practices described in this Notice.

When we share personal information

Once your personal information is collected, as detailed above, we sometimes share it with third parties for various reasons. This may include email delivery, data hosting, analytics, and payment processing. These services may collect browsing data that includes IP address, referring pages and user's movements as they navigate the App and Website. Other third parties help with our marketing efforts including sending and analyzing our marketing efforts by measuring whether recipients have opened an email and clicked on any content within it.

In addition, where you choose to, you may provide us with earnings information for us to perform analysis and reporting that will enable you to better understand your own earnings. To provide you with this service, we need to share some of that earnings information that may contain personal information (excluding your name or email) with third parties that perform data conversion and analysis services for us.

Note that when we share your personal information with a third party, we require that third party to protect that information consistent with this Notice and limit its use of that information to performing the services they provide to us.

DSC sells workforce and mobility data to cities and transportation agencies that typically includes information that is not personal information such as general vehicle information and how many passengers you carry on certain trips. It also may include some personal demographic information, including your gender, age, and ethnic background if you choose to share this information with us. This helps cities and transportation agencies understand not only transportation issues but the composition of the driver pool in their areas.

We use targeted advertising

Some vendors that we use to help us operate our Platform or promote our services also serve ads on our behalf through the Internet. These third parties may use cookies to collect information about your Platform visits, as described in the automated technologies section of this policy. They also may use information about your visits to our Platform to serve targeted advertisements that are relevant to you. Those may appear on other sites that you visit.

Our vendors help with Platform analytics, too

DSC uses Squarespace, Mixpanel, and Google Analytics to study how users interact with our Platform.

Maybe it goes without saying, but if you make a public post, others may see it

If you make a post on a third-party social media site, such as on Facebook, or by identifying us in your social media feed by tagging us using a hashtag (#) or "at" (@), your personal information may be publicly available and is subject to the privacy policies of those third-party social media sites. As a reminder, this Notice describes how we will treat your personal information once it is in our possession.

We recommend you review the privacy policies of any third-party sites you visit to understand the data collection and practices of that third party.

We may share feedback you provide to us

We want to hear how we're doing. If you have suggestions for improving our services, we want those as well. We would be delighted to receive video testimonials from drivers, so that others can learn to make the most of not only their experiences but everyone else's-after all, we are a collective.

If you opt in, we may contact you to ask about your driving experiences or get your opinion on our App updates and current projects. It's our belief that DSC works best when it acts as a two-way street, getting first-hand information from drivers even as we give that to others. So please be aware that any feedback relating to our services on our Website, App, or on social media channels may be publicly shared and used by us.

Eventual successors may access information

In the event of a merger, acquisition, reorganization, bankruptcy, or other sale of all or a portion of our assets, any user information owned or controlled by us may be among the assets transferred to third parties as successors in interest. As part of this type of transaction, we reserve the right to transfer or assign your personal information to third parties. Other than to the extent ordered by a bankruptcy or other court, or as otherwise agreed to by you, the use and disclosure of all transferred user information will be subject to this Notice.

We need to comply with legal requirements

We may disclose your information to government authorities or other third parties if any lawful circumstances arise, including when:

  • You have given us permission to share your information;
  • We are required to do so by law, or in response to a subpoena or court order;
  • We believe in our sole discretion that disclosure is reasonably necessary to protect against fraud, or to protect our property or other rights or those of other users of the Website, App, third parties, or the public at large; or
  • We believe that you have misused the Website or App by using it to attack or gain unauthorized access to a system or to engage in spamming or other conduct that violates applicable laws or our Terms of Use.

How we secure personal information

We have implemented industry accepted administrative, physical, and technology-based securing measures to protect against loss, misuse, and alteration of personal information in our systems. We ensure that any employee, contractor, or vendor who has access to personal information in our systems is subject to contractual and professional obligations to safeguard that personal information.

While we strive to use commercially acceptable means to protect your personal information, no method of transmission over the Internet or form of electronic storage is 100 percent secure. Therefore, we cannot guarantee its absolute security.

If you have received unwanted, unsolicited e-mail from us or purporting to be sent by us, please forward a copy of that e-mail with your comments to privacy@driversseat.co for our review. If you feel that any of our privacy practices or security standards detailed in this Privacy Notice have been violated, you may contact us.

Your Rights

We understand that you want to protect and control your personal information. This section details how you may review, update, or delete your information.

Viewing or updating your personal information

Update your name, contact information, email preferences, and details about your vehicle by accessing your account on the App.

Deactivating your account

You may deactivate your account any time after you create it. To deactivate your account, please send an email to privacy@driversseat.co with "Deactivate Account" in the subject line. Upon receiving your request, DSC will deactivate your account and delete personal information where required by applicable law.

Opting out of Promotional Emails

If you do not wish to receive promotional e-mails from us, you may follow the unsubscribe process at the bottom of the promotional e-mail you received or by emailing us at privacy@driversseat.co. Please keep in mind that you still may receive transactional and service related e-mails from us (such as e-mails related to the completion of your registration, correction of user data, password reset requests, reminder e-mails you have requested, and other similar communications essential to your transactions on the Platform) that may be necessary for us to make the Platform available to you or respond to your inquiries.

Identity Verification Requirement

We are required by law to verify that any request submitted was made by someone with the legal right to access the information. Therefore, before accessing or divulging any information pursuant to a data subject access request, we may request that you provide us with additional information so we can verify your identity and legal authority or require that you take an additional step such as logging into your account to validate your identity or to validate your identity through email verification To make a request, please contact us at privacy@driversseat.co with "Personal Information Request" in the subject line and provide full details about your request, including your contact information and anything you believe is relevant. We will provide a response to an access request within 30 days of receiving such request. If we cannot substantively respond in a timely manner, we will notify you and provide the reason for the delay. Under certain circumstances, we may not be able to fulfill your request, such as when doing so would interfere with our regulatory or legal obligations, where we cannot verify your identity, or if your request involves disproportionate cost or effort. But we will respond to your request within a reasonable time, as required by law, and provide an explanation.

European Economic Area, Switzerland, United Kingdom, or Canada rights

We currently do not make our services available outside the United States. Specifically, our services are currently unavailable in Canada, the European Economic Area (EEA), including Switzerland and the United Kingdom (UK). We do not intend for our Platform to be accessed by anyone in those jurisdictions. In the event we make our Platform available to people in those geographic areas, we will update these terms to ensure we reflect any additional rights reserved under applicable laws. Those updates will be made available within this Privacy Notice, in accordance with those regulations.

California Consumer Rights

The California Consumer Privacy Act provides specific rights to those who live in the state of California. If you are a California-based consumer, as that term is defined under California law, this section shall apply in addition to all other applicable rights and information contained in this Notice:

  • You have the right to request that we provide you with the categories of personal information and the specific pieces of personal information we have collected and store about you.
  • You have the right to request that we delete personal information we, or our service providers, store about you.
  • We will not discriminate or retaliate against you if you elect to exercise any rights under this section of our Privacy Notice.
  • You may request that we not sell your personal information. As noted above, we do not sell your personal information unless you have explicitly consented.
  • You have the right to designate an authorized agent to make a request on your behalf.
  • Please see the "Identity Verification Requirement" section above for more information on our process for verifying we have received a legally valid request.

You can see when this Privacy Notice was last updated by checking the "last updated" date displayed at the beginning of this Notice.
